Dog ownership rights: Is it 'the bond of care' or 'initial sale'... conflicting rulings in the first and second trials

 

1. Mr. B adopted a Golden Retriever.

The court recognizes the emotional bond. It rules to return the pet to the boyfriend.

First instance - Unlike objects, pets form emotional bonds, and considering factors such as the unilateral destruction of a bond that had been maintained and strengthened over 30 months due to the end of the relationship and taking the animal away, it is reasonable to conclude that Mr. B either gifted the animal to Mr. A or relinquished ownership.

 

The Court of Appeals 6.2 reversed the decision, stating that "there is no evidence to recognize that Mr. B explicitly expressed his intention to gift Mr. A or to relinquish ownership," resulting in the plaintiff's loss.

This is amazing.

 

Regardless of various reasons, I think it would be better for the dog if it is cared for and loved sincerely by the ex-boyfriend who takes care of it rather than the owner who keeps entrusting it to someone else.

 

A woman with no sense of responsibility bringing a dog along is...
