The White House has submitted court documents explicitly denying the role and authority of Elon Musk, CEO of Tesla, who was initially designated to lead the Department of Government Efficiency (DOGE). This stance is completely contrary to the position expressed by U.S. President Donald Trump immediately after the presidential election in November last year and is interpreted as a measure to avoid a constitutional violation lawsuit filed by the Democratic Party.

On the 18th (local time), according to foreign media such as Fortune magazine, a U.S. economic publication, White House Chief of Staff Joshua Fisher stated in a sworn affidavit recently submitted to the court that "Musk does not have any substantial or official authority to make government decisions."

 

According to court documents, Musk is merely a "White House Office staff member" rather than the "Head of the Government Efficiency Department."

This is in contrast to the stance announced by President Donald Trump, who was elected in last year's November presidential election, that "Musk will lead." Trump established the Department of Government Efficiency through an executive order on his first day in office, but now the White House claims that Musk is not leading the Department of Government Efficiency and is not even an employee of the department.

So far, Musk has taken on the leading role in the cost-cutting efforts of Trump's second administration. He appeared in the White House with President Trump and even publicly celebrated the achievements of the Department of Government Efficiency, which he claimed to have suggested the name for. Musk also claimed that he was staying at the headquarters of the Department of Government Efficiency.

According to this document, Musk is only a presidential senior advisor with the status of a non-career "special government employee," and can only advise Trump and relay his instructions.

It is claimed that Musk, who owns several companies such as Tesla and SpaceX, holds a position similar to that of former President Joe Biden's senior advisor, Anita Dunn.

However, the statement did not specify who actually runs the Ministry of Government Efficiency if not Musk.

The reason the White House drew a line with Musk is interpreted as a response to the Democratic Party's lawsuit claiming that it is unconstitutional to favor Musk, who was not officially appointed through formal procedures by President Trump.

Jeff Houser, founder of the government watchdog group Revolving Door Project, said, "The White House is building ways to circumvent legal violations or a series of loopholes," and "It is highly likely they are not honest, but we cannot prove it."

It is analyzed that defining Musk as a simple employee rather than a department head with official authority could offer several advantages to the White House. This is because it would allow avoiding questioning during Senate confirmation hearings and communication with Musk would be protected by executive privilege, excluding it from the scope of the Freedom of Information Act.
