Denies charges despite evidence... Victimized by court detention for mental health treatment

 

 

A man in his twenties, who was accused of long-term harassment of a middle school classmate and causing his death by strangulation, was sentenced to imprisonment.

Incheon District Court Criminal Division 15 (Presiding Judge Ryu Ho-jung) sentenced Mr. A, in his 20s, who was indicted on charges of assault resulting in death and special injury, to five years in prison during the sentencing trial on the 26th.

The court ruled that "the defendant claimed that they only discovered the victim collapsed in front of the cold bath and performed CPR, and did not choke the victim, but based on the relevant evidence, it is acknowledged that the defendant did choke the victim."

Meanwhile, it was judged that "the defendant, using the excuse of joking, inflicted burns on the victim, who was a friend, and committed acts of cruelty, and the victim suffered extreme pain before dying," and "even though objective evidence revealed that the victim's death was caused by the defendant's assault, the defendant vehemently denied the charges."

However, the defendant (who was indicted and detained) was released in December of last year for mental health treatment after being in custody, and is currently receiving treatment. He stated, "I will take responsibility depending on the appellate court's decision and the treatment results," and did not order detention in court.

The prosecution sought a 15-year prison sentence for Mr. A at the sentencing trial held on July 19.

Mr. A was indicted on August 31, 2022, for strangling and killing Mr. B, a middle school classmate, at a jjimjilbang in Gyeongbuk.

He was investigated for applying the jiu-jitsu technique called 'back choke' on Mr. B at the time, which involved applying strong pressure to the neck.

Mr. A is also accused of repeatedly committing acts of abuse over a long period, such as stealing money and valuables from Mr. B, setting fire to the victim's hair with a lighter, and pressing on the soles of the feet.

In August 2022, he hit B's face at a motel in Incheon, causing injury, and then falsely reported to the police that his friend was beaten by his father.
