Since the incident three days ago when President Yoon Suk-yeol declared a state of emergency, the public experiencing anxiety and fear is filing a mental damages lawsuit against President Yoon.
On the 10th, the 'Preparatory Group for the Lawsuit Claiming Damages for Sedition Acts by Yoon Seok-youl' announced that they would file a lawsuit against Yoon Seok-youl personally, seeking 100,000 won in damages per person for emotional distress.
The lawsuit was jointly proposed by Attorney Lee Geum-gyu, who was the representative for the National Assembly during the impeachment trial of Park Geun-hye, and Kim Jung-ho, who represented victims in civil and criminal lawsuits related to the memoirs of Chun Doo-hwan.
They are recruiting citizens to participate as plaintiffs, claiming that the people who are shaken with anxiety and fear due to martial law and attempted rebellion should receive compensation for mental damages. Lawyer fees are free, and all winning damages will be donated.
The target applicants are citizens aged 19 and older who are considered adults under civil law, and are the 'valuable 105 people' by region to oppose the 'Gapjin 105' list. It carries a message of protest against the 105 People Power Party members who abstained from voting on President Yoon's impeachment motion.
The preparatory meeting for the lawsuit stated in the proposal that "the act of disrupting the National Assembly and the votes of its members through the declaration of martial law and the martial law troops is not only unconstitutional but also constitutes treason under criminal law, according to the opinions of the majority of legal scholars and the judgment of the majority of the people."
At the same time, they pointed out, "Each citizen of the Republic of Korea has had their constitutional rights to national sovereignty and the formation of constitutional institutions, guaranteed by the Constitution, infringed upon and their physical safety threatened," and they lamented, "The pride and self-esteem that citizens enjoyed as owners who fought for democracy and built a mature democratic nation and society have been suddenly shattered, and they are now in a position where they must endure humiliation from the international community."
Furthermore, it is emphasized that "lawsuits demanding compensation from Yoon Seok-youl are erupting like wildfire in courts across the country, and he must be held accountable not only under the Constitution and criminal law but also in civil liability," and "Anyone who points a gun at the people must be utterly ruined so that no one in our constitutional history dares to attempt such unconstitutional acts again."
Earlier, when the impeachment motion against President Yoon was defeated in the National Assembly plenary session due to the absence of People Power Party members, citizens expressed their anxiety about a second martial law. Subsequently, President Yoon apologized to the public and stated that there would be no second martial law, but many reactions remain skeptical, saying "I can't believe it."
