Husband's alcohol bottle strikes top instructor, causing death... Reapplication for arrest warrant on charges of 'murder'
The police, who are investigating the death of the top real estate law instructor who passed away on the 15th of last month, have begun a second attempt to secure the custody of wife A.
According to News1 on the 22nd, the Pyeongtaek Police in Gyeonggi Province announced that they had reapplied for a warrant to detain Ms. A, a woman in her 50s accused of murder, on the 19th.
The pre-trial interrogation of suspect A (warrant review) is scheduled to be held at the Suwon District Court Pyeongtaek Branch on the 24th. The decision on whether to arrest is expected to be made later that day in the late afternoon.
Mr. A is accused of repeatedly swinging a bottle of whiskey at her husband, Mr. B, a 50-year-old top instructor, at an apartment in Jije-dong, Pyeongtaek City, around 3 a.m. on the 15th of last month, resulting in his death.
Person B suffered a severe head injury and was transferred to a nearby hospital, but he died around 2 PM on the same day, approximately 11 hours later.
Person A reported themselves to 112 and was arrested after the crime. During police investigation, Person A reportedly stated that "I committed the crime in a fit of anger after arguing with my husband who demanded a divorce." Accordingly, the police and prosecution applied for and requested an arrest warrant, but the court dismissed it, stating, "There is no concern of evidence tampering or flight."
However, the police secured additional evidence during the supplementary investigation process, such as witness interviews, indicating that Mr. A committed the crime with intent to kill. The most notable example is the "bloodstain pattern."
A police official stated, "If Mr. B had been standing during the altercation with Mr. A, bloodstains would have dispersed (scattered and flown around)," but explained that the bloodstains were only concentrated around Mr. B's body, which contradicts Mr. A's statement.
The National Institute of Scientific Investigation, which performed the autopsy on Mr. B's body, recently informed the police that there are skull fractures and defensive wounds.
The police official added, "After reviewing various circumstances, it is believed that Mr. A unilaterally assaulted Mr. B, who was lying down, using a dangerous object."
The police initially changed the charge against Mr. A from injury resulting in death to murder and are understood to have decided to pursue his detention again. The prosecution acknowledged this and re-applied for a detention warrant.
Under current law, causing injury resulting in death is punishable by imprisonment for at least three years. In contrast, the crime of murder can be punishable by the death penalty, life imprisonment, or imprisonment for five years or more.
